Georgia Sues the Biden Administration over Medicaid Work Requirements

On January 21, 2022, Georgia sued the Biden Administration over its revocation of Georgia’s previously approved Medicaid work requirement. The work requirement was included in Georgia’s Medicaid expansion waiver and was previously approved by the Trump administration. The plan, called “Pathways to Coverage,” would have expanded coverage to adults who met the work requirement provisions and who earned up to 100% of the federal poverty level. Additionally, those that earned between 50 and 100% of the poverty level would be required to pay monthly premiums to maintain their insurance coverage. The Biden Administration rejected the work requirement provisions in December 2021 but allowed the expansion provisions to remain in place.
